A Data Use Agreement (DUA) is a contractual agreement, between the “provider” of the data and the “recipient” of the data, used for the transfer of non-public data, or data that is subject to some restrictions on its use (i.e., HIPAA and/or Security Requirements). DUAs typically address issues around limitations on use, liability for harm arising from use of data, publication, how data will be exchanged, accessed, stored, used and protected.
DUAs for human subjects research are initiated through the Human Research Protections Office (HRPO). HRPO will trigger the HSC PreAward/SPO to begin the DUA process for protocol submissions that include transfer of data to an outside institution. For non-human subject research, please complete the Data Transfer Checklist and contact the HSC PreAward/SPO office at HSC-PreAward@salud.unm to initiate the DUA process.
